Charges Dropped on Brinson Following Accusations of Assault During Arrest
BURNSVILLE, MINNESOTA - According to a probable cause statement released by the Dakota County 1st Judicial District Court, on Monday, July 31, 2023, an officer with the Burnsville Police Department was on routine patrol when he spotted a vehicle traveling on County Road 42 with the driver of the car wearing headphones that completely covered their ears. The Burnsville Police Officer would later notice the car also had a fake license plate, often used by sovereign citizens.
The Burnsville Police Officer initiated a traffic stop on the vehicle and spoke with the vehicle's driver, who would be later identified as Jermaine Brinson. Mr. Brinson was not in the procession of a driver's license and argued with the officer that he did not need a permit or a license plate to drive. It is reported that Mr. Brinson continued to argue with the Officer and eventually rolled up his window. The Burnsville Police Officer told Mr. Brinson he was under arrest. Still, Mr. Brinson continued to leave his window shut. The Burnsville Police Officer then broke the front driver's side window to get into Mr. Brinson's car and unlocked the door from the inside to open it. He then took Mr. Brinson's seat belt off and grabbed Mr. Brinson by the wrist.
According to the criminal complaint, Mr. Brinson told the Burnsville Police Officer not to touch him. He began physically resisting the Burnsville Police Officer as the Officer tried to get Mr. Brinson out of the car. The Officer eventually got Mr. Brinson out of the vehicle on his feet. Once out of the car, Mr. Brinson refused to put his hands behind his back. While resisting, he pulled away from the Officer, began waving his arms and hands, and hit the Burnsville Police Officer's gun as he brought his hands down to his side. Mr. Brinson then began to push the Officer backward using his body force. Mr. Brinson continued to be physical with the Officer as he resisted, grabbed, and reached for the Officer.
The Burnsville Police Officer eventually arrested Mr. Brinson. The Officer suffered injuries due to the altercation with Brinson, including cuts, abrasions, and bleeding. Jermaine Brinson was officially charged on August 1st with felony 4th-degree assault of a peace officer, demonstrable bodily harm. The maximum sentence for Mr. Brinson is 0-3 years and/or a $1,800 to $6,000 fine.
On December 4, 2023, court documents show that the charges against Brinson were dropped by the State of Minnesota, following the Minnesota Rule of Criminal Procedure 30.01 under the reason “Interest of Justice.”
